The amendment to the Environmental Impact Assessment (EIA) Regulation has been published in the Official Gazette and has entered into force.
Article 1
Paragraph (b) of the first clause of Article 4 of the EIA Regulation has been amended as follows, and paragraph (ı) has also been revised as follows:
“b) Public notice: The written notice posted at the public notice boards located at the provincial directorate, district governor’s office, and village council in the areas where the public affected or likely to be affected by the planned project resides, regarding the EIA process of the planned project,
ı) Environmental impact assessment project area: The area bounded by the coordinates of the main and auxiliary units of the planned project,”
Article 2
The fourth paragraph of Article 8 of the Regulation has also been amended as follows:
“The notice regarding the submission of the application related to the project, the commencement of the EIA process, the opening of the EIA application file for public review, and the possibility of submitting opinions and suggestions regarding the project to the provincial directorate or the Ministry until the completion of the EIA process shall be published on the websites of the Ministry and the provincial directorate. Additionally, the provincial directorate shall also notify the public through public notices, announcements, and similar means.”
Article 3
The following paragraph is added to Article 25 of Annex 1 of the Regulation, and Articles 41, 43, and 44 are amended as follows:
“c) Facilities performing at least one of the following processes: crushing, screening, washing, drying, and ore preparation, with a capacity of 400,000 tonnes per year or more,”
41- a) Wind power plants with 15 or more turbines,
b) Offshore wind power plants,”
43- Solar power plants with a project area of 25 hectares or more (excluding roof and facade systems),
44- Electricity transmission lines with a voltage of 154 kV (kilovolts) or more and a continuous length of 50 km or more,”
Article 4
Finally, Articles 1 and 39 of Annex 2 of the Regulation have been revised as follows. Additionally, Articles 41 and 42 have been amended as follows, Article 43 and subparagraph (b) of Article 45 have been revised as follows, the following subparagraph has been added to Article 45, and the following article has been added to the same annex:
“1- Projects involving the gasification and liquefaction of coal and bituminous materials at a rate of 50 tonnes per day or more,
39- The extraction or use of geothermal resources (excluding other uses listed in Article 42 of Annex 1),
41- Solar power plants with a project area of 7.5 hectares or more (excluding roof and facade systems),
42- Dams and reservoirs with a lake volume of 1 million cubic metres or more,
43- Projects involving the extraction of water from underground or the storage of water underground at a rate of 300,000 cubic metres per year or more,
b) Marble and decorative stone cutting, processing, and polishing facilities with a capacity of 5,000 m³/year or more,
g) Geothermal resource exploration projects (excluding explorations conducted using seismic, electrical, magnetic, electromagnetic, geophysical, etc. methods)"
