Environmental Noise Control Regulation entered into force after being published in the official gazette.


The Environmental Noise Control Regulation, prepared by the Ministry of Environment, Urbanization and Climate Change with the views and contributions of the Ministry of Interior and the Ministry of Culture and Tourism, was published in the official newspaper and entered into force. It was stated that the aim of the regulation is to solve the environmental noise at its source.


Purpose: To prevent the negative effects of environmental noise on the environment and human health, to prepare noise maps and noise action plans, to apply noise control measures to reduce environmental noise and to inform the public about environmental noise management studies.


Scope:


(1) This Regulation; It covers the procedures and principles for the control of environmental noise and vibration arising from industrial activities, transportation, construction, music broadcasting and workplaces.


(2) This Regulation; It does not cover the noises arising from domestic activities, the noises generated by the neighbors, the noises of the workers in the workplaces, the noise in the transportation vehicles and the noises arising from the military activities in the military areas.


With the new regulation;

Within the scope of City-Specific Noise Management,

A regulation has been made that allows the protection of people and the environment in all circumstances, the protection of both the citizen and the sector, and the local management of environmental noise, taking into account the differences seen especially in tourism regions and in the inner and eastern parts of our country.


The summer and winter periods regarding the working hours of the music broadcasting workplaces can be rearranged by the decision of the Provincial Environment Committee, taking into account the characteristics of the region, strategic noise maps and action plans.


As part of Loud Sound Setting for Outdoor Activities,

Due to the fact that the noise is more perceptible due to the lower background sound level at night; It has been decided that the outdoor activities will be held between 10.00-01.00.


Music broadcasting licenses will be given to the music broadcasting establishments in line with the acoustic reports prepared, and in case of 3 violations of the acoustic reports within the same calendar year, the music broadcasting permission will be cancelled.

Within the scope of the Fireworks Permission Condition,

For the use of fireworks, it is obligatory to obtain permission from the local civil authority by informing the time and place.


Within the scope of “Continuous Monitoring System” to Noise,

Control of noise at its source and continuous monitoring of noise sources will be ensured with the sound power limiting systems to be installed and continuous monitoring systems that will inform the Ministry electronically in the arrangements made for workplaces that broadcast music and marine vessels.


For marine vessels broadcasting music; The border coordinates of the areas where music can be broadcast will be determined by the Decision of the Provincial Local Environment Committee, and administrative sanctions will be applied in case of activities outside the determined coordinates.


It will be ensured that the level of environmental noise emitted by the marine vessels broadcasting music will be monitored by the Provincial Directorate at the points determined on the coast, by means of a "continuous monitoring system".

Within the scope of Time Adjustment to Construction Sites, due to the fact that the construction site activities in the residential areas are not continuous and they are periodic activities; These activities will take place between 10:00 and 22:00.


Within the scope of “noise and vibration shield” to historical buildings,

Environmental vibration limit values have been regulated for vibration limit values in regions where historical and natural structures are located, and these limit values can be limited by sensitive and comprehensive vibration measurements and scientific studies to be made in areas where historical and natural structures are located.


Within the scope of Noise Map with 81,

In provinces without strategic noise maps, strategic noise maps and strategic noise action plans will be prepared within three years. A database will be created that will include prepared acoustic reports, strategic noise maps and strategic noise action plans.
